Below, we describe the processing of your personal data and the rights you have under current data protection regulations –Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data, and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, hereinafter referred to as the “applicable data protection regulations”.

For what purpose(s) will we process your data and on what legal basis?

Your personal data is processed in accordance with the provisions of the applicable data protection regulations, on the legal basis and for the purposes indicated below:

Performance or fulfilment of contractual obligations or application of pre-contractual measures

Your data will be processed for the purpose of managing room reservations through the various channels provided by the entity that owns the hotel.

In this regard, if you do not allow the processing of your personal data for this purpose, and since the processing thereof is necessary to fulfil the contractual obligations or application of pre-contractual measures with The Controller, you will not be able to complete your reservation.

Consent of the data subject

Provided that you have given your consent, your personal data may be processed for the following purposes:

  • Website contact form. The processing of your personal data will be carried out, provided that you have given us your consent, to manage and respond to requests for information, queries, complaints or suggestions made through the web form.
  • Commercial communications. Your data will be processed to manage the sending of commercial communications relating to products, services, promotions or any other relevant news that may be of interest to you.
  • Wi-Fi network access. Your data will be processed to manage guest connections to the Wi-Fi network.
  • Newsletter management. The processing of your personal data will be carried out to manage your subscription to newsletters.
  • Draws and promotions. The processing of your personal data will be carried out to manage your registration and participation in draws and promotions.

You may revoke your consent at any time. Please note that the revocation of consent is not retroactive.

The possible categories of data to be processed are:

  • Identifying data: Name, surname, email and telephone.
  • Social characteristics: Types of holiday travel
  • Potentially any type of data that the data subject includes in the contact made through the web form.

To which recipients will your data be communicated?

To carry out all the purposes described above, The Controller works with third-party service providers who may have access to personal data as a result of the execution of contracted services. In any case, The Controller follows strict criteria for the selection of such third parties in order to comply with its data protection obligations and signs with them the corresponding data protection agreement, where these third parties undertake to comply with their data protection obligations, and specifically to deploy those legal, technical and organisational security measures that are appropriate to guarantee the security, integrity and confidentiality of the data of the data subjects, in relation to their processing for the stated purposes.

Your data will be transferred to other group companies that own the hotels in order to formalise your reservation. This data transfer is legitimised by the performance or fulfilment of the contractual obligations established with The Controller when requesting a room reservation.

They may also transfer your data to the companies that own the hotels where it is necessary to manage your request for information; such transfer will be legitimised by your consent.

Additionally, The Controller may disclose personal data and any other user information when required by public authorities in the exercise of their legitimately assigned functions and in accordance with the applicable provisions in those cases where it is necessary.

Is your data transferred to third countries or international organisations?

International data transfers outside the European Economic Area are carried out under various circumstances:

  • To manage room availability to the company eRevMax Ltd., as well as its associated companies.
  • To manage registration to the Wi-Fi network when using the “sign in with” functionality and for the management of registration and execution of draws and promotions to the companies META (Facebook Inc) or X (Twitter).
  • For the sending of commercial communications and newsletters, as well as the management of subscriptions to loyalty programmes to the companies Fideltour and Check.

In all transfers, ensuring the adequate level of protection in accordance with the Standard Contractual Clauses approved by the EU Commission or the corresponding binding corporate rules.

How long will we keep your data?

The Controller will comply with the provisions of current regulations regarding the obligation to delete personal information once the intended purpose has been achieved, or when you revoke your consent for its processing, the information being duly blocked, for the exclusive disposal of Judges and Courts, the Public Prosecutor’s Office or the competent Public Administrations for the attention of possible liabilities arising from the processing, and only during the limitation periods of such liabilities. Once such periods have elapsed, the information will be permanently deleted by secure methods.

How have we obtained your data?

The personal data that The Controller processes is the personal data provided by you through the use of the web contact form, room reservations through the website functionality or through tour operators, information you publish on websites or social networks about the hotel, or any other interaction you carry out on our website.

What are your rights when you provide us with your data?

In accordance with the provisions of the applicable data protection regulations, as well as national data protection regulations, you have the right to exercise, if you so wish, the rights of access, rectification and erasure of data, as well as to request that the processing of your personal data be restricted, to object to it, to request the portability of your data, and not to be subject to automated individual decisions.

Additionally, in the event that the processing of personal data described is based on the consent given by you, you may revoke such consent at any time. In this regard, it should be noted that the revocation of the consent given will not affect the lawfulness of the processing carried out prior to the withdrawal of such consent.
